The Website and the products offered through it are operated by:

“KODRO”, “we”, “us” and “our” refer to Platone, trading under the brand name KODRO. “Customer”, “you” and “your” refer to any person accessing the Website or purchasing products through the Website.

By accessing the Website, placing an order or purchasing products through the Website, you acknowledge that you have read, understood and accepted these Terms and Conditions.

These Terms and Conditions apply to consumers and customers purchasing products for personal use and not for resale or other commercial purposes.

2. CHANGES TO THE TERMS AND CONDITIONS

KODRO reserves the right to amend or update these Terms and Conditions from time to time.

Any changes will be published on the Website. The version of the Terms and Conditions applicable to an order is the version in force at the time the order is placed, unless otherwise required by applicable mandatory law.

Changes to these Terms and Conditions will not affect orders already accepted by KODRO.

3. PRODUCTS AND PRODUCT INFORMATION

KODRO makes reasonable efforts to ensure that product descriptions, images, colours, sizes, materials and other information displayed on the Website are accurate and up to date.

Colours and visual appearance may vary depending on the customer's device, screen settings and other technical factors. Minor differences in appearance, texture or colour that do not materially affect the characteristics of the product shall not constitute a defect.

KODRO reserves the right to modify product information, product availability, specifications and prices at any time. Such changes will not affect orders already accepted by KODRO.

All products offered through the Website are subject to availability.

4. INTELLECTUAL PROPERTY

All content available on the Website, including but not limited to photographs, images, videos, graphics, logos, trademarks, product designs, texts, illustrations, layouts, colours, visual elements, software, documents and other materials, is protected by applicable intellectual property laws and is owned by or licensed to KODRO or its respective rights holders.

No part of the Website or its content may be reproduced, copied, modified, distributed, published, transmitted, sold or otherwise used for commercial purposes without the prior written consent of KODRO or the relevant rights holder.

Customers may access and use the Website and its content solely for personal and lawful purposes.

The KODRO name, logo, trademarks, domain names and other distinctive signs may not be used without prior written authorization.

5. USE OF THE WEBSITE

The Website may only be used for lawful purposes and in accordance with these Terms and Conditions.

Customers must not use the Website in any way that may damage, disable, overburden or impair the Website, its servers or its functionality, or interfere with the use of the Website by other users.

Customers must not attempt to obtain unauthorized access to the Website, its systems, databases or any information not intended to be accessible to them.

Customers are responsible for the accuracy of the information they provide to KODRO and for ensuring that any information relating to third parties is provided lawfully.

6. ORDERS AND CONTRACT FORMATION

The presentation of products on the Website constitutes an invitation to customers to submit an order and does not constitute a legally binding offer by KODRO.

To place an order, the customer must select the desired product and size, add the product to the shopping cart and complete the checkout process.

Before submitting the order, the customer will have the opportunity to review and correct the information entered, including the products, quantities, delivery details and payment information.

By clicking the final order button, the customer submits a binding order for the products contained in the shopping cart and acknowledges that the order creates an obligation to pay, subject to applicable law.

After an order has been submitted, KODRO will send an electronic confirmation of receipt to the email address provided by the customer.

The order confirmation confirms that the order has been received. Unless otherwise stated in the confirmation or required by applicable law, the sales contract is concluded when KODRO accepts the order and confirms the order by email.

KODRO reserves the right to refuse or cancel an order, in whole or in part, where there are reasonable grounds to do so, including product unavailability, pricing or technical errors, suspected fraud, payment issues or other circumstances preventing KODRO from properly fulfilling the order.

If KODRO cancels an order for which payment has already been received, the amount paid for the cancelled products will be refunded using the original payment method, unless otherwise required or agreed.

Information regarding delivery, shipping costs, estimated delivery times and applicable destinations is provided in the KODRO Shipping Policy.

Information regarding returns, refunds, exchanges and, where applicable, statutory rights of withdrawal is provided in the KODRO Returns & Refund Policy.

7. PRICES

All prices displayed on the Website are stated in the currency indicated at checkout.

The applicable price is the price displayed on the Website at the time the order is placed, unless there is an obvious pricing or technical error.

Any applicable shipping costs, taxes, duties or other charges will be displayed or communicated to the customer before the order is submitted, to the extent required by applicable law.

Further information regarding shipping costs, delivery times, applicable destinations and any customs duties or taxes is available in the KODRO Shipping Policy.

For deliveries outside Switzerland, the customer may be responsible for import duties, customs charges, taxes or other costs imposed by the destination country, unless otherwise stated at checkout or in the applicable Shipping Policy.

8. PAYMENT

Payment must be made using one of the payment methods made available at checkout.

The customer authorizes the relevant payment service provider to process the payment for the order.

KODRO does not normally have access to or store complete payment card details where payment is processed by an independent payment service provider.

If a payment is declined, reversed or otherwise unsuccessful, KODRO may suspend or cancel the relevant order.

9. PERSONAL DATA AND PRIVACY

The collection, use, storage and processing of personal data through the Website are governed by the KODRO Privacy Policy.

As a business established in Switzerland, KODRO primarily complies with the Swiss Federal Act on Data Protection (FADP), the Swiss Data Protection Ordinance and other applicable Swiss data protection legislation.

Where KODRO's activities fall within the territorial or material scope of European Union or European Economic Area data protection legislation, KODRO will also comply with the applicable provisions of the General Data Protection Regulation (EU) 2016/679 (GDPR) and other applicable EU/EEA data protection requirements.

The applicability of EU/EEA data protection legislation shall be determined in accordance with the territorial and material scope of the relevant legislation.

Where both Swiss and EU/EEA data protection legislation apply to a particular processing activity, KODRO will comply with the requirements applicable to that activity.

Further information is available in the KODRO Privacy Policy.

10. COOKIES AND SIMILAR TECHNOLOGIES

KODRO may use cookies and similar technologies to operate the Website, remember preferences, analyse Website usage, improve functionality and, where permitted, support marketing and advertising activities.

The use of cookies and similar technologies is governed by applicable Swiss and, where applicable, EU/EEA data protection and electronic communications legislation.

Where legally required, KODRO will request the user's consent before using non-essential cookies or tracking technologies.

Further information regarding cookies is provided in the KODRO Privacy Policy and, where applicable, through the Website's cookie consent mechanism.

11. THIRD-PARTY SERVICES AND LINKS

The Website may contain links to websites, services or platforms operated by third parties.

KODRO does not control and is not responsible for the content, availability, security, privacy practices or terms of third-party websites or services.

Customers who access third-party websites do so at their own risk and should review the relevant third party's terms and privacy policy.

KODRO may use third-party service providers for payment processing, hosting, website functionality, analytics, marketing, customer service, shipping and other services necessary to operate the Website and fulfil orders.

12. WEBSITE AVAILABILITY AND TECHNICAL LIMITATIONS

KODRO will make reasonable efforts to keep the Website available and functioning properly.

However, KODRO does not guarantee that the Website will always be available, uninterrupted, secure or free from errors.

The Website may occasionally be unavailable due to maintenance, technical problems, updates, cyber incidents, network failures or circumstances beyond KODRO's reasonable control.

KODRO will not be liable for interruptions or technical failures to the extent caused by circumstances beyond its reasonable control, subject always to mandatory applicable law.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, KODRO shall not be liable for indirect, incidental or consequential losses arising from the use of the Website or from circumstances outside KODRO's reasonable control.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms and Conditions excludes or limits liability for intentional misconduct, gross negligence, death or personal injury, defective products, breach of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.

14. FORCE MAJEURE

KODRO shall not be responsible for delays or failures in the performance of its obligations where such delays or failures result from circumstances beyond its reasonable control.

Such circumstances may include, without limitation, natural disasters, war, terrorism, governmental measures, epidemics, strikes, supply chain disruptions, transport interruptions, customs delays, telecommunications failures, cyber incidents, power failures or failures of third-party service providers.

Where such circumstances materially affect an order, KODRO will take reasonable steps to inform the customer and, where appropriate, offer a solution in accordance with applicable law.

15. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by applicable law.

The invalid or unenforceable provision shall, where legally possible, be interpreted or replaced in a manner that most closely reflects its original purpose while complying with applicable law.

16. GOVERNING LAW AND CONSUMER RIGHTS

These Terms and Conditions and the contractual relationship between KODRO and the customer shall generally be governed by Swiss law, without prejudice to any mandatory provisions of consumer protection law that apply to the customer.

Where a customer is a consumer habitually resident in a country whose mandatory consumer protection laws apply to the transaction, nothing in these Terms and Conditions shall deprive the customer of the protection afforded by those mandatory provisions.

Where KODRO offers products to consumers in the European Union or European Economic Area and the relevant transaction falls within the territorial scope of applicable EU/EEA consumer legislation, the mandatory consumer rights applicable to that transaction shall be respected.

This may include, where applicable, mandatory rights relating to pre-contractual information, distance contracts, withdrawal, delivery, conformity of goods, legal guarantees and consumer remedies.

The fact that these Terms and Conditions provide for Swiss law does not exclude mandatory consumer protection provisions that cannot legally be waived.

17. DISPUTE RESOLUTION AND JURISDICTION

KODRO encourages customers to contact KODRO directly at  info@kodrostore.com  before initiating formal proceedings so that any dispute can be resolved efficiently and amicably.

Subject to mandatory consumer protection rules, disputes arising out of or in connection with these Terms and Conditions or a purchase made through the Website shall be subject to the jurisdiction of the competent courts in Switzerland.

Where mandatory law grants a consumer the right to bring proceedings before the courts of their country of residence or another competent jurisdiction, this right shall remain unaffected.

Nothing in this section limits any mandatory rights available to consumers under applicable Swiss, EU/EEA or other applicable law.

These Terms and Conditions, together with the KODRO Privacy Policy, Shipping Policy and Returns & Refund Policy, constitute the terms and information governing the use of the Website and purchases made through it, subject to any mandatory rights and provisions applicable by law.
